1. Acceptance of Terms

By downloading, installing, or using the Eat Real AI mobile application (the "App"), you agree to be bound by these Terms and Conditions ("Terms"). If you do not agree to these Terms, do not use the App.

2. Description of Service

Eat Real AI is a mobile application that uses artificial intelligence to analyze photos of meals and provide estimated nutritional information. You can take photos within the App, upload photos from your device, or import photos from your Instagram account for analysis.

3. Account Registration

To use the App, you must create an account using your email address and a password, or by signing in with your Apple ID. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to provide accurate information and to notify us immediately of any unauthorized use of your account.

4. User Content

You retain ownership of the photos you submit through the App. By uploading or importing photos, you grant us a limited, non-exclusive license to process and analyze those photos for the purpose of providing nutritional analysis. We may use anonymized and aggregated data derived from user content to improve our AI models and services.

5. Instagram Integration

The App allows you to import photos from your Instagram account. By using this feature, you authorize us to access the photos you select. Your use of Instagram is subject to Instagram's own terms of service and privacy policy. You may revoke access to your Instagram account at any time through the App settings.

6. Disclaimer of Accuracy

The nutritional information provided by the App is generated by artificial intelligence and should be treated as an estimate only. Results may not be fully accurate and should not be relied upon as a substitute for professional dietary or medical advice. If you have specific dietary needs or health concerns, consult a qualified healthcare professional or registered dietitian.

7. Acceptable Use

You agree not to:

• Use the App for any unlawful purpose
• Upload content that is offensive, harmful, or violates the rights of others
• Attempt to reverse engineer, decompile, or disassemble the App
• Interfere with or disrupt the App's servers or networks
• Create multiple accounts for abusive purposes
• Use automated means to access or interact with the App

8. Intellectual Property

The App, including its design, features, AI models, and content (excluding user-submitted photos), is the property of Eat Real AI and is protected by intellectual property laws. You may not copy, modify, distribute, or create derivative works based on the App without our prior written consent.

9. Termination

We reserve the right to suspend or terminate your account at any time if you violate these Terms or engage in conduct that we determine is harmful to other users or the App. You may delete your account at any time from within the App. Upon termination, your right to use the App ceases immediately.

10. Limitation of Liability

To the fullest extent permitted by law, Eat Real AI shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the App, including but not limited to damages resulting from inaccurate nutritional information, loss of data, or inability to access the App. Our total liability shall not exceed the amount you paid for the App in the twelve months preceding the claim.

11. Indemnification

You agree to indemnify and hold harmless Eat Real AI, its officers, directors, employees, and agents from any claims, damages, losses, or expenses arising from your use of the App or violation of these Terms.

12. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify you of material changes by posting the updated Terms in the App and updating the effective date above. Your continued use of the App after changes constitutes acceptance of the updated Terms.

13. Governing Law

These Terms shall be governed by and construed in accordance with applicable laws, without regard to conflict of law principles. Any disputes arising from these Terms or your use of the App shall be resolved through binding arbitration or in the courts of competent jurisdiction.
